Proposal to Amend the Constitution of the Commonwealth of Virginia

For your consideration: December 10, 2010

Honorable Senators and Delegates;

Now comes me before the legislature, and

WHEREAS, I am deeply concerned about the direction our federal government has taken over recent years and the adverse affects some of its actions have had and will have on the rights and liberties of the citizens of the Commonwealth; and

WHEREAS, the Tenth Amendment to the Constitution of the United States reads as follows: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people"; and

WHEREAS, the Tenth Amendment defines the total scope of federal power as being that specifically granted by the Constitution of the United States and no more; and

WHEREAS, the scope of power defined by the Tenth Amendment means that the federal government was created by the states specifically to be an agent of the states; and

WHEREAS, the states today are demonstrably treated as agents of the federal government; and

WHEREAS, many federal laws are directly in violation of the Tenth Amendment to the Constitution of the United States; and

WHEREAS, the Tenth Amendment assures that we, the people of the United States of America and each sovereign state of the United States, now have, and have always had, rights the federal government may not usurp; and

WHEREAS, Article IV, Section 4 says that “The United States shall guarantee to every state in this Union a Republican form of government,” and the Ninth Amendment states that ”The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people”; and

WHEREAS, the United States Supreme Court invalidated the Gun-Free School Zones Act in United States v. Lopez, 514 U.S. 549, 115 S.Ct. 1624, 131 L.Ed.2d 626 (U.S.1995). although well meaning the act overstepped the bounds of regulating commerce it's invalidation thereby reinforcing the enumerated powers clause of the Ninth Amendment; and

WHEREAS, the United States Supreme Court has ruled in New York v. United States, 505 U. S. 144 (1992), that Congress may not simply commandeer the legislative and regulatory processes of the states; and


WHEREAS, a number of proposals from previous administrations, and other proposals that may be anticipated, may further violate the Constitution of the United States; now, therefore, let the Constitution of the Commonwealth of Virginia be amended as follows:

"The Commonwealth of Virginia hereby claims sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States. The Commonwealth by this amendment serves notice to the federal government, as our agent, to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated powers. Further, no federal legislation shall become binding on the Commonwealth of Virginia unless such legislation shall have a basis under the enumerated powers of the Constitution or shall have been passed into law by the Commonwealth of Virginia."

Keep up the good work and vigilance Virginia patriots! We still have the Virginia Firearms Freedom act to move through the legislature and to Governor McDonnell's desk. Even after this session we will have to keep up the momentum and public awareness, because in the next session we have the Virginia Nullification Law and the sovereignty amendment to the Virginia Constitution coming up.


The bipartisan support these 10th amendment bills are getting this session bodes well for a Virginia Constitutional Sovereignty Amendment to really give the Attorney General something with teeth to stave off further unconstitutional encroachment by the federal government

The legislators are listening. Your visits, emails and phone calls have not been for naught. This is exciting stuff and you all are the fire behind the 10th Amendment movement.

Twenty-four hundred citizen grassroots activists made their voices heard at the state capitol bell tower on January 18th and the Virginia legislature listened.

Even before Obamacare is made federal law, the Virginia House and Senate has voted to stand up to the powers of Congress to mandate that every citizen purchase federally approved health care coverage.

Senator Jill Vogel's SB417 passed on the House floor moments ago with a vote of 66 - 29. We expect Governor McDonnell will sign the Virginia Healthcare Freedom Act into law the moment it crosses his desk.

The House version, HB10, was passed by the full House yesterday by a vote of 72 - 26. The bill is on it's way to the Senate where it is expected to pass with bi-partisan support. But regardless, Virginia will not have to comply with federal mandates to purchase health care insurance once Governor McDonnell signs SB417, and likely HB10, into law.

Under Obamacare, if you file your tax return and fail to offer proof that you have a policy that puts you in compliance with the law, the IRS will try to penalize you, possibly by garnishing your state tax refund. If you live in Virginia, you will have the Commonwealth in your corner. Virginia's Attorney General has vowed to challenge the feds in court should any citizen of Virginia be penalized for not purchasing federally approved health care insurance. This legislation also opens up a test case that could get ObamaCare thrown out by the U.S. Supreme Court.

We have effectively reaffirmed our position that it is "we the people" that set the course for this nation. Governments are instituted by the governed and will not be usurped on our watch.

The Virginia 10th Amendment Revolution Moves Closer to Complete Victory

Del. Bob Marshall's HB10, the Virginia Healthcare Freedom Act, passed on the House floor yesterday with a bi-partisan vote of 72 - 26 and will now move to the Senate. The vote went like this:

The Senate version of the healthcare bill had it's second reading on the House floor with debate yesterday with the third and final reading and vote today. You can watch streaming video of the vote today at noon here.

The Virginia Firearms Freedom Act passed victoriously out of the Militia, Police & Public Safety Committee this morning with a bi-partisan vote of 17 - 2. Delgates Scott and Keam were the two who voted "nay". HB69 will now move to the House floor for a vote next week.

It goes to show that, unlike the Washington Empire, lawmakers in Virginia understand that it is their constituents who harness the power to elect them to office and know they must listen.

The Utah Senate and House have passed SB-11 the Utah Firearms Freedom Act! It is awaiting signature of the Senate President and transmittal to the Governor for signing into law! http://le.utah.gov/~2010/htmdoc/sbillhtm/SB0011.htm There is a revolution afoot in the land! Keep the 10th Amendment fires burning there is still much more to do.

I hear there is one gun assembly plant somewhere near Fredericksburg. Perhaps they will expand their operation to manufacture guns.
